Mrs Ext15, went into the back of someone (stationary at lights), at about 5mph..

Apart from a slight mark on both vehicles, there was no damage, and the occupants seemd fine..

This took place a month ago, she never informed the insurance company as there had been no contact from the driver.

She's now had a rather indepth solicitors claim for the driver, soft tissue damage to the neck, sleepless nights etc (learner, female who started crying)..

This took place on the 23rd August, on the 3rd of September our policy lapsed with Aviva.

So what course of action is best?

They are making claim to section 152 of the Road Traffic Act.

Not too sure but notify the company that was insuring you at the time of the crash (Aviva was it) they should cover you for it... they may be abit funny about the fact you never notified them.

I had a crash a number of years ago, it was 50/50 fault the other guy and his mrs claimed for the old soft tissue damage, loss of earnings blah blah... they won and there are that many corrupt doctors and ambulance chasers prepared to sign peices of paper for the right amount of money chances are the "victims" of the 5mph traumatic accident will win their case... and this is why we pay so much in bloomin insurance premiums!!!

I'm no legal expert though!!!

 
i would seek immediate legal advice on that one. Very tricky area.

Although there probably thinking "we can now make some money easy when nothing is wrong with us"

If no insurance companies were notified at the time of the accident, how can they prove it was your wife that hit them?

Was your wife even there? ;) its your word against theirs!!

i had one of these last year, but not cars.

my dog "supposabley" bit some one, who entered our house without permission! via a long drive, 2 sets of CLOSED Gates.

they try anything!

anything for some cash!

did you exchange details at the time ???? witnesses ????

would like to see the doctors report and the photos of the damage to the car !

im sure that at the lights the person in front put the car in reverse by mistake ???? on a mobile phone,smoking a spliff ????

and you thought oh never mind no harm done ????

deny any knowledge of the incident

 
Ext - Admin 2 is being a very naughty girl in #4. You must not lie to insurance companies, that would be fraud. It is a serious offence, just as bad as claiming for something that never happened.

Also if the driver was a learner they would have had a witness!

The best thing to do is to contact the insurers at the time. Did you pay a few extra quid for the 'legal expenses cover'? Usually offered as an extra for

Just phone up the company who were insuring you at the time and say that you've had a claim for personal injuries for a bump that occurred xx months ago.. and go from there.

Legal protection has absolutely no use for you in these circumstances. it's for when you want to make a claim, not for when you have a claim made against you..

What a sad society we've become..

It was the driving instructor who made the claim (passenger), not the young learner driver..

Total bull, her claim in my honest opinion..

We'll just contact the IC and pass the details, I'm sure they've heard it all before..

a friend of mine falsely claimed for whiplash when he got hit from behind when in a taxi.

The taxi driver said he earns about 8 grand a year on whiplash claims and instructed my mate and his wife to do the same.

They both went to the docs and got examined and each said their doctor told them that they could actually feel where muscle had come away from the base of the skull and they could feel knots in muscles and stuff.

This is quite scary really cos it shows the incompetence of these doctors and how many times have they misdiagnosed before.

 
If you have ever actually had whiplash then you know how it feels..

I had car accident a good 10 years or more ago.. at the time I felt perfectly ok (it was a Friday), when I went to work on the Monday I couldn't hold my head up (it was ok when I held my head up, but when I was looking down it felt 10 times heavier and ached) I was off work for a week..

The accident,, someone tried to cross (in a Metro) a dual carriage way while I was driving down it in a Sierra at 65mph. The front end of my car left the floor and all I could see was the Metro's wheel bouncing down the road.

 
I was involved in a slight accident about 18 months ago. I was sitting in my car in my car in the supermarket carpark. A lady reversed out of her parking place and hit my pride and joy. My Favourite ordinary Ford Escort. It is ordinary but I like it. Any there was scraped paint work on the front skirt. She was very apologetic and admited responsiblity. When I took it home and washed it it was scrapped but you could hardly see it. My insurance company company wanted to take it away and get it repaired. I said I did not want it to be repaired until her insurance accepted responsibility. this eventually happened and I got a letter from them accepting responsibilty. So I was contacted again my my insurers. They would collect the car from my door, supply me with a replacement car, and the garage bill for the repair was over

 
I always thought that in these situations we are told..

"by our insurance companies" NEVER admit any liability..

you just have to pass over your contact details and your insurance companies contact details.. and they should sort it all out???

Admitting responsibility at the scene of an accident almost always invalidates your insurance. Never accept liability even when you hit the tree......

That's the normal state of affairs for my neck - hence I took on an apprentice :^O

 
My first car was a Metro............. :D
Don't remember Robert Hardy or Christopher Timothy driving one of those in the TV series. ; \
