Does down-lights in the kitchen have to be IP rated. ?

I had this with elecsa, I installed an 8.5kw shower to wash hair in a shop that was being turned into a barbers. I said the existing lights aren't ip rated and the nearest socket is 2mtrs away. They said no need to bother as the shower was being used with the sink, therefore treat it as a sink and not a shower.But what if you have one of those rinse hose's in the sink has it then got to be ip65 because of water jets or is it ok being over 2.25 metres !!!!!!!Have I started an argument !!!
