Return of dodgy sander

Hi do folks

Dont know if anyone can help but i would really appreciate any advice on this.

Bought a sander on the 11th Nov.

A part of it broke off and i returned it last week....8th Dec.

Would not refund / exchange.

They sent item to manufacturer to see what they would do; fix/ exchange /refund.

Doesnt seem right to me .

It has been a week now and i still have not heard anything.

Have they acted correctly or could I have a full refund as it is within the 4 week period.

Im trying to keep cool with this lot but its difficult when they are so ignorant!!!!

Much appreciate any replies on this.

Bought it from a local firm - Tipadels

make was Ryobi - not the best but not the worst either.

however I wont be buying Ryobi again.

Wont be buying from this firm again either.

Paid for in cash.

Wasnt that expensive but its the principal of it really.

I suppose there are different policies whereever yougo.

I have returned stuff to loasd of plasces before and been refunded with no problem.

Yes you are entitled to your money back!

When you purchase anything you have statutory rights under

The Sale Of Goods Act 1979.

&

The Supply Of Goods and Services Act 1982.

The key pivotal point is that

"Everything should be of Merchantable Quality"

and

"Fit for purpose"

If something fails or breaks within an unreasonable timescale it can be considered that it was Not fit for purpose OR of merchantable quality, therefore the Seller is in breach of there part of the contract.

If the seller is in breach of contract, You are entitled to your money back..

Or you can request a repair or replacement.. (however some items may not be repairable or replaceable.)

The general agreed duration that anything should last is dependant upon the product..

but the typical assumption is anything that fails within 6 months was NOT fit for purpose!

Go back and tell them they are in breach of the

And you are requesting your statutory right to a refund.

and if the are not willing to comply, ask them for the name of the store manager and tell them you will be going to trading standards to pursue the mater further!

i shall give this a go.

Its nice to be armed up with a few facts like this.

Have read in a few places that they are acting within the law by trying to repair the item.

However my contract was with the retailer and not the manufacturer.

Ill throw some of this info at them, hopefully tomorrow and see waht happens.

more than anything it was the a######e behind the counter that got me goat.

After doing a little survey around this town it seems that all of the similar type of retailers have exactly the same policy.

the best advice it seems would be too buy from a reputable retailer....

The sander in question is now on its way back to me after being repaired.

I shall just have to accept it this time I suppose.

I mentioned what was suggested but was told that they must be given a reasonable opportunity to fix it.

Also annoyed with meself for not buying something which was of better quality ....

They are fobbing you off there with CARP!!!!! X(

You did say it was less than 6months old didn't you?

Assuming the item you purchased was NEW, not second-hand, not refurbished...

Then no they MUST NOT be given the oppurtunity....

They should offer you the choice of a free repair OR a refund.

1/ I they agree it needed fixing... it therefore FAILED and broke.

2/ If it failed and broke it was NOT fit for purpose or of merchantable quality!

3/ If they sold an item that was NOT fit for purpose... They are in breach of contract....

Go back and re-read that second link I posted earlier.

DO SHOPS HAVE TO GIVE ME MY MONEY BACK

Id admire your sentiments on this though.

It would be worth persuing this for the hell of it ........

By the way the item was less than a month old.

As you say I was not offered the choice of a refund ....just a free repair.
