Hi there

I was just wondering what you lot would do if you where me. I have currently been in an accident, and chopped my finger off (At work)...

I work for a one man band, so there is only me and him, and we where lifting a 1000m drum of 1.5 SY onto some home made Cable Jacks... one side of the jacks collapsed and pulled my hand through and as the cable went down it trapped and cut off me finger

been out of action for 8 weeks now, they have put it back on and the out come looks good, I do not agree with suing people as it was just an accident , and my boss is a good bloke, But...

I was just interested what you would do:

Would you sue?

If you did, would you be made "redundant"? As you would p+ss the boss off and as there are no jobs out there would it be worth keeping quite?

Like I said, I am not going to sue, I was just wondering what you lot thought!!

You'd probablly be looking at 3 grand for the injury, plus loss of earnings.

Have you now got full use of the finger back, or is it still causing you grief?

Has your employer paid you whilst you were off work?

Have you discussed your options with your employer?

Do you really want to work for someone who will sack you if you claim off of his insurance, after all,that is what the insurance is there for isn't it?

If you claimed, and he then sacked you, would you be able to go to a tribunal for unfair dismissal?

I agree with the points above. As long as he has liability insurance, you'll be getting the money from the insurance company not your boss (his premium may rise though). It's what it's there for and being a businessman I'm sure he'd understand you need the money!!

 
If it was me and:

1. I had been paid in full whilst not working

2. My finger was going to be ok afterwards (even if not quite 100% yet)

3. My job was secure and I liked what I was doing

Then I wouldn't claim.

Accidents happen. as long as everything was well in the end i probably wouldnt claim

as a side note, has anyone heard some of the adverts for making claims on the radio? best one so far is about something that went wrong during surgery, woman is going on about how she isnt interested in blaming and doesnt want it to happen to someone else etc etc... next line is about them helping her to sue NHS!

Like I said, I think due to the current job climate, the fact my boss is not a bad bloke, and it was just an accident, I am not going to sue.

Although I am only on Statutory sick pay and about 4K down now!! :-( I think the thing to do, is have a chat when I get back and ask for my loss of earnings.

I think that is the least I am entitled to.

The main reason why I have insurance is to pay for items like this.

You have to be protected at work by good working practice and financial cover for mistakes or accidents.

I could not afford a suit against me in person, but my insurance covers me against every eventuality.

I could have claimed against a former employer for an accident that I had some 10 years ago But I choose not to because financially I did not loose out, whilst in recovery he paid my full salary.

However if you are prevented from working and your employer is not as sympathetic the I would sue, you have to pay the bills or you loose everything.

 
i cant believe ur on stat sick pay, u should at least be on a basic wage and if you did this at work should get an average wage from the last 12 months ..

did he report the accident to health and safety ?

I think you should have a word with your employer,

if he is as good a bloke as you say then he will prob say to sue his insurance company,

happened to a friend of mine something similar,

only on a saturday job(foreigner) for the boss at his house, the boss went through all his insurances and told the bloke to make a claim(he had to have a pin put in his arm).

I would think your boss should be well insured, and if not then he is simply put an idiot.

but I can symphathise with your concern in the current job climate, but bills still need to be paid.

BTW, your finger will never be the same, I have lost a part of one of mine, and another one saved, still know about it 15+yrs on.

Its a tricky call, I can't really offer much advice,

The only thing I would suggest is have a word with the Citizens Advice Bureau.

They should be able to confirm what the legal obligations, options, and possible outcomes or later complications are for each of the courses of action or non action.

I though about getting a volt stick put on the end? Or a Terminal Driver?

Any other ideas?

I think it is defiantly worth having a chat with the citizen
