Even the builders with whom I have worked for about 20 years wouldn't take anything from by toolbox without asking .

OK  these days I 'd hear a shout ....  " Deke , !!  I'm borrowing your terminal driver "          Usually followed by "  Gonna lever up a manhole cover with it " or similar jolly jape.
OR........I will replace it next time I go to Screwfix!

 
IMHO any proper trades person should be capable of knowing what tools and materials he/she will need for that days task.....

If you arrive on site without the correct tools or materials then you are nearer a cowboy than trades person!

So you either buy your own or hire any special tools you need before getting to site so you can do the job correctly professionally and efficiently... 

without having to waste time trying to get hold of a widget removal tool.

IT ISN'T THAT DIFFICULT TO KNOW WHAT YOU NEED!!!!

and ..

you cannot assume someone else will be there AND they will have any extra tools that you need.

Recent job builder asked if I had a mask he could borrow....

he was grinding out some mortar ready for re-pointing..

How can you not know that a face mask may well be needed !!?????

(I had an old one, not used it for 18months+...  I did lend it..  & he did give it back.. 

But i just threw it away cus it was all crapped up with his dust & sweat!! )

The exception to this would be a DIY / homeowner asking to borrow something while you are there. 

e.g. had customer needed a specific Allen key to dismantle some furniture they were moving...

no problem..  sorted done & returned...

from ProDaves initial post I read it that the person who borrowed his ladder could well have been a DIY not "trades person"

So the need to borrow was acceptable... 

But NOT asking first..

My neighbour borrowed my steps.......I asked several times for them back......nothing.

I have an LED moving message sign in the front window (Don't ask) I put a message on it saying that if you lend anything to my next door neighbour, you may not get it back.

Two days later, knock at the door, neighbour with my steps.

 
I lent someone my beautiful Britool torque wrench in 1978, Have still not had it back... I know they still have it and use it, but the way i see it, it was daft to lend it out, as, once it is out of your sight, they could wreck it in seconds. Lent someone a car once, they wrote that off in about 5 minutes and i had a fine for no tax......

My neighbour was sued and lost, because a painter took a broken ladder out of a skip on his premises when working on his premises (rented commercial not his residence), the ladder had been broken when attached to the scaffold around the outside of the property, so the scaffolders had removed it and skipped it and replaced it.

The painter had seen it in the skip, and needed a ladder, why they did not have their own, as per the above comments goodness only knows.

The ladder slipped and broke as it was damaged, unsuitable for the task and being used incorrectly.

However, as the premises owner, and thus the person with the duty of care in law for the premises and all activities there in, my neighbour was prosecuted and lost.

Apparently he had a legal duty to ensure that the painter used the correct access equipment, in the correct manner and that it was suitable and sufficient, he also had a legal duty to ensure that the damaged ladder must not have been able to be re-used once identified as faulty and placed in the skip.

The painter who did all this and got injured also got the compensation.

Even though there were witnesses to corroborate what the painter had done.

My neighbour also got heavily fined, but did escape a prison sentence.

 
My son had one of my ladders in his back garden

His missus rings him to say ....somebody is on the roof

He went home...house next door has a bloke on the roof fixing ridge tiles

He has used 'my ladder' to get on the roof!

This is a council property, bloke is a subbie and could not be bothered to get HIS ladder from HIS van as MINE was closer!!!

Son remonstrates with him....bloke says ladder is dangerous and should not be used!....at this point bloke is still on roof.....BAD move on his part!....big mistake REALLY BIG MISTAKE!

Son removes ladder....tells bloke "in that case I will make it safer for you, mate!"

Bloke begs son to replace ladder!

Son goes back to work....only a five minute walk away AND it passes the subbies offices.

Son calls in to tell them "if you have lost an employee he is on my neighbours roof crying, go and ask him why!"

 
Long gone customer had a cast iron gutter built into wall.

Gutter leaked

Found a firm who would supply custom EPDM liner

Only guaranteed if one of their registered installers fitted it....fair shout

Firm arrives to install.....three day job

Part way through day one....knock on the ladder

Who is in charge?

Bloke........Me why WTF do you want

Other bloke.....Me?.....HSE! You HERE NOW!

No edge protection

No harness

No goggles

No ladder....access off top of transit van

Prohibition notice issued

Company also had NO INSURANCE!

MY CLIENT got a bollocking as they should have ensured it was all done correctly as they were the 'employer,

They argued that they were using a "registered company"

Cost them a fortune AND they were now on HSE radar!

After that you could not fart without the correct piece of paper
