Warning to Construction Industry Tax payers

Some contractors do insist on it but I have heard that they cannot. For example, I have my own UTR (unique tax reference) and this should be proof enough to any contractor that I am legally responsible for paying my own tax and therefore any invoice I isue to them should not be able to be taxed at the prevailing rate by them for CIS purposes.

 
We were told , when CIS was inflicted upon us, that anyone in the construction industry must use the CIS scheme, by law. Personally I find it a pain in the rectum . Most of my customers are commercial and industrial so do not come under the CIS but working for a builder or paying the sparky who works with me , it has to be the CIS , unfortunatly.

However , I point you to the CIS booklet IR14/15(CIS) page 27 last paragraph which says " We will waive the contractor's liability where it is satisfied that the person to whom the contractor made such payments has made a return of income or profits which includes the payments and has paid the income tax for that income"

My wife is disabled, has an operation two years ago ,comes home, got to have care for 5 weeks. I ask about some kind of benefit as I won't be working... sod all ........ eventually someone I know who works at Social Services says " You're self-employed.... you have a bank account .. you're white.. you're English ...you don't live in the inner city areas ... don't even bother !! You'll be wasting your time. " And I was.
Sounds like discrimination to me. The problem is that as a self-employed person (or even just an employed person) you don't have the time to devote to creating a storm over this and therefore get some action in your favour just to keep you quiet.

It is a sad indictment of our society where "fair" and "common sense" no longer feature. It makes me wonder if there is a plan somewhere in the halls of governmental power to totally ruin the country.

I think you are right, Pyro.

Governments of both colours seem to have been hell bent on ruining this country since the 1960,s , starting with Harold Wilson's Labour lot who thought it was clever to tax the high earners at something like 90 % . Quickest way to prevent the likes of Richard Branson from starting up companies, creating wealth, employing people and investing in Britain.

 
i phoned up once about a query, and they said( by automation ) that they were having trouble with the new computer system and that i should call back later. I thought they meant try again in a few hours, but then they said call back in a FEW WEEKS. :|

Cissus I agree with you but hasten to say that I have heard of guys being fined by the CIS for not operating the scheme. A small builder we know decided to ignore it and was fined .

It seems to be a grey area and one that exists to benefit the tax man only. Personally, I can't be bothered to tow the line and never have had the inclination. I keep things simple. I invoice my customer, they pay me, and if I have used anyone to help me, they invoice me and I pay them. I can prove an audit trail and that is all that counts imo. They get their tax is the most important thing from their point of view.
