Anyone clued up on legal advise??

I need some legal help.

I bought a vauxhall vivaro 5 weeks ago, absoloute mint condition only done 25k,

now 5 weeks on the fuel system has gone and the cost of repair is

 
Sorry to hear about that. I was looking at one of these and am quickly going off them.

You shouldn't have to pay but it depends how quickly you need it. I am very surprised the garage hasn't just "done the right thing.

They may argue that if you carried on using it after the pump failed that caused the injector issue and they won't pay for that as its a secondary problem. Who is this warranty though? If its a 3rd party then call them.

I would badger them and threaten legal action until they move their position but I have been accused of barratry before (luckily never by anyone I was opposing and that included 2 firms of solicitors).

I would suggest giving them one more chance to put it right and if they refuse, explain to them that your next option is to hand this to a solicitor and you will additionally be looking to recover his costs from them too.

I wouldnt buy one!! Once the fuel pump actually goes the van cuts out so i have not used it once the fault has occured, but the fuel pump gradually falls to pieces inside the fuel tank over a period of about 2 months.

As much as we'd like to, true legal advice cannot be obtained from this forum, becasue of the implications that entails.

But good ideas and suggestions, are the more likely.

They may be able to help......

 
I have been in touch with trading standards and they think i have a good case but that is as far as they go with advise and recommend getting a solicitor.?
Perhaps the best move you can make, but get one experienced in this area.

It could well be a long haul.

And I still think, Vauxhall should be more forthcoming.

And remember, All communication in writing - sent Rescorded Delivery (Sugned For) and a copy of every letter to be kept for records.

Whilst I understand how frustrated you are. Be careful with what you say on here.

I just bought an x reg dispatch and got a better warranty !!!!!

I would be tempted to get it parked on their forecourt with a sign in the windscreen saying

"dont buy a vivaro they are crap and the after sales help here is pants"

on a serious note how much is it going to cost to get fixed ?

Thats done it for me.

I was looking at getting a Vivaro....... might take a look at something else now.

Unfortunately not applicable on second hand goods

And unless Vauxhall agreed transfer of remaining manufacturer warranty to new owners in the original sale they are not obliged to do so now, and as they are loosing money hand over fist currently very unlikely to help out of good will

I'd also recommend talking to the CAB it's free

Check your bill of sale, does the warranty explicitly limit to max of

 
Take care with the pitching your tent outside the dealer with deflammatory placards this could be considered libellous and could backfire
As long as it is true (statement only of facts) it would be very hard to loose a libellous case brought by a company (just do not single out a specific individual) under English law, but I would not want to test that in a court. In theory, at least, the defendant does not need to prove that the statements are true; the plaintiff must prove that they are false. I would strongly advise not to take this course, however, as it may prejudice any other legal action taken.

As I said before, I would give them one more chance before going to a solicitor but do tell them your intended legal course so you can help them make an informed (and hopefully expected) decision.

well the garage are on the phone to my other half, she is doing the talking as i would only end up getting very very mad and prob messing it all up.

Not sure yet, i ended up on the phone as well and had a right go at them, told them what trading standards said etc and they seemed very worried but they are now gettin there solicitor on the case as well so it looks like i got a battle....

but while all this is going on im loosing money as i have no transport:(

Maybe ask your Solicitor, if you can claim your lost income from them? And possibly hire/ lease purchase of another van so that you can continue to work?

 
My son's new car has just blown the turbo, he had the car for 6 weeks when it went, it took 3 days to get them to admit it was covered by a warranty, just got to wait and see how long it takes them to fix it.

I would definately go to CAB in the first place as Robojin said in his post, and take all the documents you have with you.

I hope you get it sorted soon, no van, no work costs more than you can afford this day and age.
