Commercial Work In Hotel

Hi, hope someone with knowledge will know this, I'm not an electrician, But have a small medium hotel and I live on site. We know a great spark who has done some excellent work for us already. 

Our 5 year electrical safety certificate is due for renewal for heath and safety, which I would like to get done. However it appears that our electrican is not registered with NICEIC and instead registered with elecsa although he does do plenty of commercial work.

The local council (Torbay) explained that NICEIC is the required standard to meet their criteria

I have explored the various legislation and it does not seem to mention that this is the case. Can councils set their own policy on this.

Can I get another NICEIC electrician to do the safety inspection and then get another to carry our the required works

Hi, Many Thanks for your quick reply we pay our business rates to Torbay and they inspect the premises to make sure it is compliant every year. I'm not an electrician.

 
My view is anyone who is COMPETENT can do an EICR, which members of elecsa should be,.

The council is wrong, there is no "NICEIC standard".  An EICR is a set procedure within the wiring regulations, and there is a model form in the back of the wiring regulations than any competent person, scheme member or not, can fill in.

Regardless of who does the work, it will be the same certificate that you get, except it will have the logo relating to which scheme member did the work.

I would just get it done by any competent person and then make a BIG fuss if the council won't accept it, because they bloody well should.

With regard to getting work done, this is commercial, so does not come under Part P, so again there is no need to be a member of any competent person scheme, you just need to be competent to do the work.

There are no legal requirements to use anyone registered with a specific scam, or anyone registered with a scam at all. get your regular sparky to do, give report to council. if they say anything, ask them to put it in writing why they want someone to be registered with a specific scam even though there are plenty others, and what backhanders they are getting from NIC

and iirc, its illegal for a council to insist on it too, but im sure our legal expert will know more

 
Providing your electrician is competent then there is no legal reason why his inspection will not be perfectly valid for your establishment. NICEIC & ELECSA are both part of CertSure  http://certsure.com/  which manages the quality standards of both brands. Therefore if one is acceptable then both should be acceptable. There is no obligation for the person doing an inspection to also be the person doing any remedial work (if required). The standard is the guidance of BS7671 with both trade bodies work to.  Tell the council to read the Certsure website and look at the logos in the bottom corner.

I would say you need to check the small print on your agreement with Torbay CC. Ifthey state they require an NICEIC registered contractor and you have signed up to it then that is what you need to do.

The devil is in the detail of the contract on this one.

so what is he supposed to do? ask a different council?

 
Public Sector bodies cannot specify a "scam", private companies can.

Torbay is a Public Sector body, thus they cannot legally insist upon an NICEIC contractor.

 
I'm sure we've had this kind of question before on here..

The main thing that you need to do is to keep the council licensing body on good terms or they might get arsey with you over all kinds of things in the future.

I'd then get the name of the person at the council who's stating these requirements and ask them if you can use someone from a different registration body... If he says no then ask him if he minds speaking to someone from Elecsa regarding this issue

Apparently Elecsa have someone who's sole job it to "clarify" these issues,,, get them to give this person a ring

 
I'm with ELECSA & have had this occur with a printing work's insurance company .

Although , over the last 22 years we have installed all the machines & Presses etc, rewired 95% of the premises ,  upgraded the supply from 100A  to 300A , the insuers insisted upon an NICEIC electrician to carry out an inspection.

I got the ELECSA lady to phone the insurers and all was well .     The NICEIC only business is generally a leftover from the days when there was just the NICEIC .  

 
It's perfectly legal for the insurance company to require a specific scam.

They are a profit making organisation, not public sector.

They can be correctly advised however.

Nope, if the same origin of supply is for the guest house/B&B/hotel then part p applies to all of it.

 
now you know why I pay money to NICEIC as my scam of choice. Plymouth CC insist on AC registration for all works done for them, don't see how this can be applied to a hotel? However there is 1 point to consider, should the hotel burn down due to an electrical fault would your insurers pay up? Your insurers would probaby insist that who ever you use is AC (Approved Contractor) status ie registered for commercial electrical works and noy just domestic. Not sure if NAPIT etc etc have an equivalent status for commercial works.

Check a few things out. I'm AC NICEIC registered, if necessary I may be able to work alongside your regular guy to get the result you need, but not this side of Xmas as I'm firkin busy!
