They are not legally allowed to do this, as a public body they must allow any equivalent scheme, and all the schemes claim equivalence to NICEIC AC.

It's not contractual like it is with your insurance company, it's legal, because they are a Public Body, they are not legally allowed to specify a profit making company to do any works, they MUST give a specification as it were. They cannot simply state NICEIC AC.  The PAO would have a field day, and TBH, they could be taken to court by any of the other scams over it.

 
Your insurers would probaby insist that who ever you use is AC (Approved Contractor) status ie registered for commercial electrical works and noy just domestic.
Again, as the owner lives on site it is probably classed as a dwelling so this is irrelevant which means that they should all suffice.

Stroma and ECA also cover commercial so NICEIC is not the only one so the same point stands there really.

 
We used to be NICEIC  , which was  required  by Police , Barclay's Bank, West Midlands Health authority,  MOD & B,ham City Council .

Deke, Now it is only Barclays bank that can legally demand the NICEIC!

The rest, being public bodies are no longer legally allowed to specify a profit making organisation to undertake the work they require.

A bit like something we came up against some years ago with the local council.

We were invited to quote for various works in the city ,   but there was an ammendment in the specification which stated that 0ne third of the contractor's workforce onsite MUST come from certain parts of the inner city  ( Shown hatched on the attached map!!!!  )    These areas were ( obvious to a local ) high ethnic population areas .  

We got round it on the first job by only having two men on it  ( Both indigenous caucasian, somewhat pale looking types with broad  whinging Brummie accents, of the bacon sandwich & pints of mild in the pub variety ) (( Can't have a third of two men))       

We then heard that one of the huge  contractors building the new Symphony Hall etc raised the matter with The Iron Lady and the amendment from the left wing council was deemed to be illegal & has not been heard of since.

Yes you are right there Sidey ... as you say , public bodies  but it was certainly the case back then .    Although the NICEIC was the only relevant body then , unless you count the ECA .     Long before Plart Plee ... 15 th & 16th edition days.

TFL for example insist on FORS membership to be on their books.  Saying it is illegal is obviously not  the case given the FACT that everyone is doing it and no one is being prosecuted.

I honestly don't know.

If they have shareholders and trade as a Ltd. Co. then they are obviously not, so if they are a profit making enterprise then they can do as they like.

Plus, if their insurer demands this then they may not be able to do much about it unless challenged, and then they can take this challenge to their insurer, who may or may not be willing to look at this.

After all an insurance company only exists for the benefit of its shareholders, the same as any other company, that is to make profit.

Is there another option to FORS?

IF there is no other option then they are fine, but, if there are, then they can't do it.

If they are challenged, it does not need to go to court, if they give in immediately, this saves face and they save money.

Can ELECSA electricians carry out industrial and commercial work?

Commercial and industrial work is not assessed as part of an assessment for application or continued registration for ELECSA registered firms, however these firms may at their and purchaser’s risk undertake this work outside of their ELECSA registration. 
 
I think ELECSA do what they call Full Scope ...........not sure if they charge for each  ...Phart Pee  & Can't cope !

Other than it costs me around £600  a year I can't raise much interest TBH .  :(

Not sure if it is part public or private anymore and I'm a Londoner!You won't get me on the tube either especially now we're bombing Syria.

I think it's a BJ thing to protect stupid cyclists from themselves and help the environment with newer vehicles (does this apply to vw's I wonder)? It's just another sticker really!

I work for the council / NHS and I'm not AC! just a lowly DI. :(

NICEIC is just a brand now, owned by the shirtsure group or ashirtlifter group or whatever they are called for tax reasons this week. The electrical safety council / electrical safety first are a charity run alongside(?) NICEIC, they do... well I'm not sure really...but gives the shirtlifter group another seat at the top table and they are best buddies with the LFB.

Can't say I blame you with one Ducky,   our city centre has the big German Market until Christmas ......... we usually go but the Missus is worried , given the numbers of would be terroists who are already here.    Security was massive last year ,,whats it going to be this year.?

If anyone finds that offensive ...what do you expect ?

Mrs Duck is off to Bristol next weekend and is worried about beheadings on the underground. :(

Strange world at the moment...cuts to just about every public service, people wanting to kill us in our own country for not beliving the same medieval nonsense they do and the bankers and politicians are laughing their heads off & f*****g pigs!

Ohh well Amendment 3 is out soon maybe that's enough to push me over the edge. :lol:
