Just heard on 5 live.

so the years of rumours are true, there was a blacklist that big companies used to check prospective workers.

Taken from a news page

"Names of more than 3,000 construction workers blacklisted for trade union activity are reported to have been seized from an office in the Midlands.

The blacklist has been a rumour for 20 years. As a former trade unionist I'm just pleased to see it has finally been revealed.

Like the idea of a customer blacklist - some of the idiots.......

 
It is a very grey area...as I dont believe "blacklists" are illegal?

The article is about the ICO prosecuting Ian Kerr as he breeched the DPA.

I know several companies who use "consultancy" firms to obtain history on potential employees. As long as these "consultancy" companies comply with the DPA and only supply information (and not judgment) then they are legal to operate - I believe.

It is very hard to prove that a company has rejected a potential employee due to their "union activities".
