As has been said before, you need to calm down.so summing up. i tell the boss that his best mate is a **** and i refuse to use most of the machinery, bearing in mind a few small facts.
This is correct and has actually happened.totally wrong,in a court of law you would have to prove your competence,
having exams is one part of this,
also being able to show experience is another,
the judgement of your peers would be , IMHO, the most positive stage in this episode,
this would most likely be achieved via the use of professional witnesses if required.
so the short answer is NO, if you claim to be competent, and the person responsible for hiring you accepts that at face value without checking up then both you and he would I think be jointly liable and both go to court, and hopefully jail.!

look, i am carm, im just ****ed off!!, its a private firm turning over about 6 mil a year ant the small managment team (wife=MD hubby head of dept.........ect are on a kick back, the less they spend, the more bonus they.....you can work out the rest.As has been said before, you need to calm down.Don't go in all guns blazing and yell your boss that his sparky mate is a $&*?
Instead, be level headed. IF there is a genuine fault on a machine, such as missing or non working estop, then simply tell the boss the machine is unsafe for use, quoting the relevant regulations that it does not comply with, and tell him you have locked the machine off for the safety of the workforce until the defects have been rectified.
Don't aportion blame, because although you suspect who is responsible, you have no proof. All you can do is state the facts that a situation is unsafe and needs correcting to prevent injury to employees and prosecution of the company.
YESthere must be a way of blowing the whisltle without putting my self on the dole!!!!!!
