Hi all, First off i would think that the HSE would be a complete waste of time. I had to report someone to the local trading standards recently, they were completely useless, and i gave them the best case ever!!

I took out car insurance in instalments. They told me that the interest rate was 13% then, all documents came from a finance firm [Eh, nobody said anything about finance companies to me, and i certainly never signed anything] Anyway, the documents that came showed that the interest rate was actually 38%.

I went back to the insurance firm and cancelled it all [lost

 
so summing up. i tell the boss that his best mate is a **** and i refuse to use most of the machinery, bearing in mind a few small facts.
As has been said before, you need to calm down.

Don't go in all guns blazing and yell your boss that his sparky mate is a $&*?

Instead, be level headed. IF there is a genuine fault on a machine, such as missing or non working estop, then simply tell the boss the machine is unsafe for use, quoting the relevant regulations that it does not comply with, and tell him you have locked the machine off for the safety of the workforce until the defects have been rectified.

Don't aportion blame, because although you suspect who is responsible, you have no proof. All you can do is state the facts that a situation is unsafe and needs correcting to prevent injury to employees and prosecution of the company.

Manator and Sidewinder have made a very good offer to you,, post some photos and the "guys" will help you out, but you will have to compile any report very factually and without any opinion or emotion

 
HSE will take all reports very serious, and will act upon them, it is not the same as reporting to other bodies, they will act, it is in their nature.

 
totally wrong,in a court of law you would have to prove your competence,

having exams is one part of this,

also being able to show experience is another,

the judgement of your peers would be , IMHO, the most positive stage in this episode,

this would most likely be achieved via the use of professional witnesses if required.

so the short answer is NO, if you claim to be competent, and the person responsible for hiring you accepts that at face value without checking up then both you and he would I think be jointly liable and both go to court, and hopefully jail.!

This is a fundamental principle of H&S Law, even one of our members (with a law degree) will give in on this one, even though it, as other laws have their limitations.

if they do visit site and find something dangerous, then can stop all work until issues are made safe. and they can take person responsible to court for it

look, i am carm, im just ****ed off!!, its a private firm turning over about 6 mil a year ant the small managment team (wife=MD hubby head of dept.........ect are on a kick back, the less they spend, the more bonus they.....you can work out the rest.

Are you all saying that when i walk rould a factory and can see blaitent posilbe leathal faults ive got to tell me boss .......and if he does nothing............what????????????????, there must be a way of blowing the whisltle without putting my self on the dole!!!!!!

You are confusing consumer law and statute H&S law.

HSE will act, they themselves are legally bound to act.

Do you know any HSE electrical inspectors?

I do.

Trust me they know their stuff, and would have the factory shut down and the boss in clink before you could even find the relevant legislation to quote it!

They can do more than that Andy!Did you know that they have a permanent court warrant as part of their HSE ID card.

There are 3 organisations that you cannot refuse entry to a business premise.

well yes, I was using KME as this thread being health and safety,

but I did think the NI guy could enter too,,,,,

so we have,

HMRC

HSE

and I dont know who else then...
