I would guess that the outcome of whistle blowing to your boss would result in

(a) Nothing being done .

(B) You being voted the least popular guy in the works.

© Reasons being found to get you sacked

You obviously feel strongly about this, I'd guess he is not a member of any trade body , no member would be that rough IMO.

I think you have three options .

Report safety issues to your Union Rep (if you have one)

If not, report direct to the company's H & S officer .

If no action , report to the HSE.

Do you consider the work to be a danger to life ?

Do you consider the work to be dog rough, a disgrace , but not endangering life or liable to cause an accident. ?

Zeff737, you have not wasted anything, the training you have had gives you some status in your objections, without this qualification you could not stand up and be counted. What you will learn with time, is the lesson we have all had to learn, and this is were experience kicks in. We have all from time to time been incensed by the actions of our peers, or work mates, or employers,when we know we are right but unable to do anything about it.

Your employment and continued position will depend on your unbiased fair aptitude to your tasks. Sidewinder has extensive experience with employment law and health and safety, he has also offered you some assistance in how to resolve this. It is no good going on a mad explosive outburst, as this will solve nothing. The best bet is to compile a file with your findings, we can help you with this, and present it to your employer. This will serve two purposes, 1) it will show your commitment to the company, 2) it will, if presented rightly,show that you have highlighted and shown your employer of his legal duties, to which he may be fully ignorant of.

remember that while a machine might be missing an e-stop with wires hanging out,,, it may not be dangerous as it might be isolated and locked off!

Some of those other problems that you have seen might be historical fault/problems which may have nothing to do with this guy,,, he may have also brought these problems to the managers attention who may not have authorised these repairs..

Back in the real world,,, he does sound a bit "bodgit and scarper"

Prepare a "case" and you can sort this.

The one thing that you MUST do is be level headed and impartial.

Your wording and your expressions MUST be such that you are protecting the company and its officers from possible litigation.

If you think that any machinery is unsafe or unfit for use then you should refuse to use them and give your supervisor and or boss your reasons, if they then refuse to take any action on your concerns then a phone call to the HSE will sort them out

zeff, this is a one time offer, and I am sure this forum will stand by you. If you want to resolve this and show how professional you are not only in your duties but in your commitment, then first of all calm down.

We will help you to compile a report, which will be professional in presentation, and just state the facts. To help compile this we would need some photographic examples, we will then add the appropriate regulation numbers, and the recommendations that should be taken to rectify the problems.

The file should be presented without prejudice,and be factual and not based on personal interpretations. Under no circumstances should you take any retribution on the contractor, even though from your description we all know he is a phallic object, you must not let this influence your judgement.

If you want this help, then calm down, put a level head on, and let this forum show its might.

Oh & zeff, trust me & other members will back me up on this, and I am NOT saying this to be big headed.

It is doubtful that this so called "spark" is as qualified as I am.

On top of this, you have the might of the collective experience of this excellent forum behind you.

You do need to calm down and become objective, it is frustrating, and I am going through the same with one of my major customers now where by they are being ripped off by contractors cheaper than I am, but, the work they do is 5h1t3 and does not comply with statute law or even guidance and 7671!

 
so summing up. i tell the boss that his best mate is a **** and i refuse to use most of the machinery, bearing in mind a few small facts. I work one shift, the firm runs three.

Jobs up here in yorkshire are hard to come by...so the poor sods on minimum wage will do as their dam well told by the boss, which if ive not already mentioned is the best mate of the spark.

My hard work, C&G certs, and hard earned cash would on the face of it been better used to wipe my arse with and i can still take silly cash off mugs for bodging there companies electricals and theres no one thats gunna check it if the boss is happy.........happy days, any one know some one cheap to sign write my van??????
