Looking for some advice.

I came home after visiting my father to find my neighbours builder has painted their side of the fence dog egg brown. 

The 💩 brown has dripped through the panels and the trellis is all messed up.

This is my fence, on my land which I built and payed for and I did not want a dog **** brown fence.

It's only a few months old and was a nice golden colour not dog 💩 brown.

I have had to put up with years of bad tenants, take care of any urgent maintenance and recently put up with months of building work and my youngest boy not being able to have a nap during the day which quite frankly is making him quite unwell.

I'm so angry right now.

Where do I stand.

Trouble with neighbours is always hassle.

IMHO the best way is by a nice polite discussion and see if you can get them to volunteer to remedy the situation.

If not then CAB is probably your next step.

I spoke with the builders (cheech & chong) and they said they would paint my side dog 🍳💩brown. 

:facepalm:

I don't like the idea of them dictating what colour MY fence is....  :swear:

know it can be complicated a awkward with neighbours but so far I have put up with a lot of 💩 from them.

Although I am still enraged any thoughts are welcome.

calm down, calm down.

lets face it, they didn't deliberately set out to dribble fence stain to your side, trouble is it will be hard to do anything about. You might get away with something like a darkish green or possibly blue. Personally I like the blue colours, it shows off the foliage of plants better than anything else I've seen. Try a few sample pots and see what works best.

 
I have to agree with binky, its not their fault the fence coating ran into your side, I would guess they said brown as most fences are indeed brown and they have some left over. (Although mine is as binky says, its blue) Tell them you don't want brown but you want..............what ever colour you choose. Its not worth falling out over.

If it helps some of my neighbours have had new upvc windows and guess what colour it is..............yep, brown and it really does (in my opinion) look like its been smeared with....

Sorry Richard, I have to disagree, it, is, their fault, they did the painting, they could have prevented it.

I do agree that they need to try and avoid falling out over it though.

I also agree though that the Duck needs to keep calm, thrashing about in the water, and he could break a wing! ;)

I agree with Andy. It wasn't theirs to paint and they should have asked your permission in the first place. The damn cheek! 

I'd be raving too. My missus would be even worse. 

 
We had the same at our old place, they painted the fence blue on their side (it was our fence) and it all ran through.

Agreed though, these things can escalate and get VERY nasty.

You'd think it would be a good thing, work wise, but whenever I am asked to do CCTV in such a circumstance I always say no or make an excuse not to quote.

And get both a copy of your title register AND theirs, and see what it says. I expect it will have an entry in the "charges" bit concerning ownership of fences..

IF it turns out that is IS your fence, that would make it criminal damage, but i would think you would have to show "mens rea" That being the case, you would be back to trespass to property or negligence, so you would have to sue them in a civil court.

If it is a party fence, [most are] then i do not think there is much you can do, he owns it as well as you, and he has a right and indeed a duty to maintain it. If this involves painting the thing, then so be it...

Get a copy of the register £3 each, and see what it says [and post it on here!!]

It could be worse. I've just been reading the Sunday papers and a woman in Tyrone had her fence disappear plank by plank over a few weeks. It turned out the next door neighbour a 35 yr old polish alcoholic was stealing it for firewood, when he was fined £250 he asked the judge through a translator if the job centre would pay the fine.

Yeah but is it. 

If it is a party fence, then it is owned on each side by each neighbour. Perhaps blue duck had no right to build the fence. You need the full facts of the case.
