Batts. You cant withhold certs for non payment.
I think you find I would, the way I see it is if I have not been paid the job is not finished, job is not finished until I have been paid.

 
Sorry mate - I`d agree with Ian on that one. They`ve got to have the certs regardless; witholding cert against payment is a definite no-no.

I`ve never done it, and would never do it.

But how can you issue an invoice for incomplete work? You say the job isn`t finished, yet you expect the customer to pay you.

I agree,

I do on occasion say to the customer that I will release the cert once I receive payment,

but in all honesty if only they knew how idle a threat that was....... (dont tell them BTW.)

you cannot AFAIAA ask/demand for payment until the work is complete, and it is not complete until the client receives a cert stating that said works are complete and comply with all relevant regs at that time.

most/ (all in my experience) will pay up as soon as you state the cert is available, though in my situation it is usually a mutual handover, or a delivery/call back tomorrow for the money/cheque.

 
KME, I would agree with what you are saying but as the only time I have not been paid is by builders I am saying I wil not give them the certs until I have been paid made the mistake of giving one the certs then got knocked for

 
Batts, thats what the small claims court is for. That and you possibly need to get tighter on written amendments of contacts to protect yourself. While I totally understand why you would do it and feel the exact same way and would want to withhold them too, its not acceptable unfortunately.
