Octopus still charging 40p / 7.5p off peak?

I thought the 40p was supposed to be capped to 33p by the govt?

for those outside of contract on a variable tarrif yes, however there is nothing to stop you taking out a contract at a higher rate (in this case, to get reduced rate off peak)
