Subby approached by client!

Anyway, the last job I did for him was not directly through him. He was building the extension, got me to quote on the electrics and his client then asked me for a full rewire - my contract obviously with them.

who cares about the ins and outs,you took work from him and he is looking to take work from you..dont moan about it man,makes you look bitter,take it on the chin and move on,im sure it will happen again hopefully in your benefit

Lol no need to apologise mate. Spoke to my mate/subby and we have decided he will give me job to price, he will quote it and I will turn up to do it.

he didnt take any work from the builder, he worked directly for client on the same job as the builder. only thing the builder could have lost out on would be anything he adds to his invoice, which i would imagine he would have added to the job anyway

 
so the builder asked him to quote the client direct,or was he asked to quote the builder.if your a subby who is asked for a quote it goes to the the main contractor not the client
its all been mentioned in this thread. try reading it without jumping to conclusions.

 
I have not read any of the posted answers, simply because they would have little value.

Firstly if you have a cast iron service and/ or supply of service contract, a detailed quotation, and a watertight contract you have little to worry about. If you have none of the above, then just have a pint, cry into your beer, and think of how you can write your contracts better, or, how you can afford to pay some "geezer" to break the little leg bones , and any other bone not liable to breakage without extreme persuasion. Luckily the approached mate was a true mate, with morals.

Ok, I see this like this,

Builder - gives you work on extension

You - gain re-wire from work

You - sub out re-wire

builder - approaches your subby to now do his work for future jobs?

I don't think theres any laws/contracts been broken. The builder is free to use whichever contractor for his next project. Its just normal cut throat business.

Don't beat yourself up about it mate, if you didn't like him you should have been steeling his customers first!

 
I have a client who is a developer specialising in extensions. I have worked for him since Oct 2010 when I went Ltd. He is a bit of an arrogant so and so and thinks he is business man of the year. Anyway, the last job I did for him was not directly through him. He was building the extension, got me to quote on the electrics and his client then asked me for a full rewire - my contract obviously with them. So, In Dec I placed one of my subbies who happens to be my old mentor when I was his apprentice and is also a good friend on the job. All was completed satisfactorily. So, I get a call tonight from my friend who says the developer has called him asking him to do his next job instead of me! Of course, he spots cheaper labour. Now, my mate has told me that he has been approached but I want to bend this dodgy builder over good and proper now. Is there any way that I can claim he is in breach of any kind of contract by approaching my mate or is this totally justifiable?
Unless you have some written exclusivity contract with a builder or sub-contractor...

then I don't think legally anything wrong has been done. Maybe not very honorable?

But if you do have a contract, a quick read of its terms will indicate if any breach has occurred?

BUT I think this is just another case of free market forces! :C
