Asbestos cover up - help needed please!

Been working on 2 rewires this week where the guys had overboarded the ceilings. So there we are, drilling / chiselling holes in the ceiling when the H&S independant consultant turns up out of the blue. He asks for site foreman by name who then promptly denies the fact he is foreman saying he hasn't been told he is and he is a subby chippy. H&S guy asks if he has been on Asbestos awareness course to which he replies "no". Asks for a copy of the method statement / risk assessment etc which he finds and then H&S guy points out that we have been working on 2 ceilings which have tested positive for Chrysotile asbestos in 26 samples! The report had not been made available to us and the 'foreman' didn't know he had an obligation to point it out to us! There were also bags of Chrysotile floor tiles which he had broken up BEFORE the asbestos report was even given to him and the bags were left lying around in the properties!

Of course, now the carp hits the fan, he 'closes' our site down and said if he was with HSE he would move to prosecute our company. My boss is asking if I can do anything else in the property like chase walls while it is all being sorted out! When I explained it was now a contaminated site they advised we get out.

Now, I am fuming because I have been coming home each night, taking my clothes off, dumping my trousers on the floor and shirt goes in washing pile and boots sit in the corner. The kids have jumped all over me when I got through the door and this has happened for 3 days! Now I know the risk is low, but there still is a very real risk and my company has just emailed me a method statement that they have just knocked up in case the HSE arrive tomorrow! I have been told to get paper suits, gaffer tape, full ppe (disposable) and an HVAC to carry out wiring of the remaining flat tomorrow. I am really unhappy about it as I have already been exposed with my mate and don't see how in 26 degrees we can be expected to suit up, use the HVAC and wire all circuits through the loft space / ceiling wearing this get up all day.

Am I being unreasonable? Anyone know my best course of action regarding the whole thing? I must say, I am tempted to tip off the HSE about the whole thing.

DONT cover up for your company,

I have power drilled 50mm and 100mm and even 150mm holes in assy for years before it all come to light how bad it has been,

now we/you know DO NOT take the chance.

tell your company you want a full risk assessement and method statement before you will even open the door. they are/have been breaking the law.

I could rant on but I'll leave it to someone that puts words better than me.

BTW,

This site is now contaminated under the statutory "asbestos" regs so it must be decontaminated or passed as safe to enter by an independent specialist before you return, or again a criminal offence has been committed.

You can't get away from it as you KNOW what has gone on.

The risks are very nominal. However this should be a major concern for you and your family.The first thing you should do is make sure that all work clothes that you deem to be contaminated place in a plastic bag, which should be sealed and then placed into another bag. Do not burn! Contact the HSE and voice your concerns, they will advise you on decontamination and any action you should be taking. It is a very serious concern, but the risk is minimal if you follow the instructions you receive.

May sound silly, but with the shirt and trousers is it not enough just to put through the washing machine on their own?

NO is the short answer, contamination from asbestos is one of the industries major unseen killers, and is transported by micro pores far too small to be washed away by washing.

 
Thanks guys, will speak with the HSE in the morning for guidance. Think I will tell my boss I won't be in as I am seeking professional advice on my situation.

 
IF you have house insurance or mortgage insurance they may be able to help with fees for getting you assistance to take this claim forward?

 
How dare your boss tell you go back into a contaminated site !!!!! Do I see him getting his overalls on .....No.

I guess the risk to yourself UP TO NOW is low as the ceilings were overboarded .

Phone the HSE ,ask them not to quote you.

To focus your mind I can tell you that I received an email from my ex boss recently, who went to live in Spain some years ago . He is being treated for asbestosis !

 
I contacted HSE yesterday and they are now looking to prosecute and it is being viewed as a serious breach of the law. My van now has to be air tested as does the site which ha shut down. I have had to double bag all of my clothes and will be ordering a new washing machine today. Trouble is, my boss has not agreed to pay for any of it saying that if the air test comes back clear then there is no need to pay!
