Part P sign off problems - Advice needed

i have had electrical work done in my house by an nic eic installer and have not been issed a cert and the work has not been notified. the work was energised over a year ago.

best he could do is denie ever being there, or if has done dead test say it was never energised

if all fails bc will have to step in and do retro

i would have thought bc could be more helpfull with your problem, this cant be the only case of sparky doing a runner, dieing, kidnapped ect, they have had to deal with

 
if he hasnt been paid he could also go to court demanding his materials back,(?)wouldnt they still be his until he is paid for them.?
Although you can claim they are still your goods legally you can;t go round and rip them off the wall. There's a couple of threads on this but in short, unless there's any written contracts floating around then the homeowner can technically sue the electrician for damage to his property, even though the damage has resulted in sockets and lights appearing.

 
^ as above. whilst they do belong to you, you would have trespass/break in to get them, since i ver much doubt they would give you permission to remove them

 
Has the OP actually asked the electrician if he has tested the works ?

I have been in this situation a few times where the builder has disappeared without paying us. The last time, a 2nd builder phoned me up as out test label was on the consumer unit. He said he had been brought in to finish the works as the last builders had disappeared and did i have the installation certs and the part P notification. I told him, just as all of our work this has been tested in full, but our contract was with builder No1 who had the paperwork ( not exactly true). If we were paid what we were owed then copies could be made available for builder No2. I also said the job was not 100% complete so the notification had not yet been applied for. In this case the whole house was finished except 3, 5A MK sockets plates for lounge lighting that had been on back order.

Edit, this was over 10 months ago now and we have heard nothing, even though i know the client had witheld

I can;t see that would make a difference, the basic gist is that the electrician will not issue certificates until he is paid his

 
Gent, Surely the builder is at fault here. Why are we slating the sparks. I've been on a job for the past few months, large extension inc. new board. The board went in first, fully tested at that time as has everything else that's been added. The job is still not quite complete hence the EIC has not been signed and handed over. Why should this be considered wrong?

The OP should be onto the builder using the full force of the law. If he has a good reason for not finishing the job let's hear it. Do we know for sure th ejob is finished (electrics). We can't beat the sparks without knowing.

Yep. It's a contractual issue with the builder, the spark isn;t witholding the cert from the homeowner as such. He is being paid to provide wiring and certificates, no payment = no completion of job = no cert.

Trouble is Lurch part p providers will not back you up on this had this on a job when builder would not pay. Who I am withs view was if job is finished you have got to give certificate with in 30 days but to me if you have not been paid the job is not finished. But as long as they get there money they don't give a monkeys about you.
