Hi guys,

I have a mock exam question which I hope you might be able to help me with, its the only one that is not clear to me at the mo..............

The provision and use of equipment regulations are:

A: statutory regulations governing all places of work

B: statutory regulations applicable to small factories only

C: statutory regulations applicable to large factories only

D: non statutory regulations for use a guidance

Any help would be appreciated :)

At a guess I would have gone for A

Yeah, having looked through the hse guidance of puwer 1998 I have decided to go with D

 
I'm guessing you have been looking at HSE ACoP L22?

What does the acronym, "PUWER98" actually stand for in full?

Have you actually looked at "PUWER98" rather than the HSE guidance?

Did the HSE guidance if it was L22 not give you some clues?

BTW "D" is wrong! ;)

 
The Health and Safety at Work etc Act 1974 (HSW Act) is criminal law aimed at protecting employees and others who may be affected by work activities. It is enforced mainly by HSE and local authorities.

PUWER98 is a part of these regulations.

I would agree with this, The Health and Safety at Work etc Act 1974 (HSW Act) is the overriding act, under which many other things fall, and it is law.

But from a quick read I would say PUWER98 falls in the same category as BS7671, something you really should do, but not compelled to do, so If I got it as an exam question I would have to go for D. If you don't meet the recommendations you'r up in court to prove you met the " The Health and Safety at Work etc Act 1974 (HSW Act)". But I'm looking at this as an exam question:)

Sorry philbas, but you are completely WRONG, ;)

Statute law is statute law whether it is an act or a regulation.

This is a fundamental requirement of understanding what you have to do to comply with the law when being a spark.

There are probably a dozen others that are statute law & acts of Parliament that put 7671 "to shame".

To be a competent spark you MUST know ALL of these and comply with them at ALL times.

I concede , I must admit my first thought was that the answer was A, which it is, but a very quick Google after a bottle of wine, did lead me to believe that D was an option. I really should only reply to threads before I crack the wine open :(

 
Philbas, the document you link to is the guidance note and is intended to show "how" to comply with the regulations. You can comply by other means providing that you do comply. It is a statutory regulation and can be dealt with in criminal law.

Sidewinder also makes a very solid point that we all should listen to, many statute laws are a part of our work and you should be aware of these legal responsibilities, ignorance of them is no defence.
