Hi,

Just started subbing to a building firm who want to pay me net so will be deducting tax.

Thats fine taxing the labour but theyve asked me to do a few eicr's next week and believe I remember sidewinder saying something about eicr's/testing is not taxable under cis.

any thoughts please gents and ladies

You might already be aware,,if you turnover more than £30.000 you can register to be paid Gross .....

 
Going by Stepp's list I'd say that testing / carrying out EICR,s  is not covered by the CIS system . 

Most builders think they have to deduct CIS from everyone TBH. 

If the Building firm insist on paying you net   ( I always bang on about this)  make sure they issue you with a monthly statement of what they have deducted, also make a note of it yourself .     I know of cases where subbies have had CIS tax deducted....main contractor does not pay it in to HMCR ....Main contractor moves to another location ..........later in the year the subby finds he has to pay the tax again on his NET income ...because the contract with the main contractor was all a bit casual, nothing in writing ,  they,ve changed their name  etc.

Professional Services are exempt from CIS.

You need Professional Indemnity Insurance to do an EICR.

As it would not be covered by Public Product or Employers Liability.

THus doing an EICR is a Professional Service.
