Hi guys

I work on the books for a company whos main contract was morrisons supermarket, I served my time in a proper apprenticeship doing many different types of works, new build morrisons stores, warehouses, lots of commercial and industrial work, also went on loan to a firm doing council house requires! (not my cup of the but each to their own) this involved lots of working away. Then I had kids and went into the support services side which was basically reactive an proactive maintainence for morrisons. Here lies my problem, NG Baileys have just taken the contract from us and looks like in for the TUPE transfer! Anyone worked for baileys? Do they have to keep my existing contract? I'm jib pay rates at moment and baileys have pulled out ain't they? Anyone know what there paying? And finally how long do they have before they can bin you or change your contract if you transfer with same T&C's?

Not good times for me!!!!

 
TUPE means they have to maintain your terms of employment.

However I believe there's a "loophole" if you get transferred a second time, TUPE no longer applies.

so the time to worry is when the new company wants to pass you off to a third company.

We earned good money in those days, it was JIB rates but 12 hours a day mostly 6-7 days a week, I only stopped with them because I got fed up of travelling, that's when I went self employed.

You are a number at the end of the day and that's it, if they are the same these days you will be fine.

Also under tupe rights the new company if u do move over they can also put u on 90days notice to change the T&Cs of your contract

And also come in and put you all under notice that your jobs are at risk, this happend to a former colleague of mine
