i have an outstatnding invoice worth only 100 quid that remains unpaid and the client is using every excuse not to pay. what would you do? i dont really want to just take it on the chin out of principle. these people have the money but are so far up there own backsides they think its ok to do as they please. would you reccomend the small claims for such a small amount? your views welcome please headbang

Several large friends and a couple of bits of 4x2?
ROTFWL - exactly what my immediate thought was!

More seriously though - not sure if it's worth the headache going through a small claims court for that amount (even though that's still a decent amount of money!).

I'm interested to see what others think too as I've often wondered what I'd do if I was in that situation???

What are the reasons there giving to not pay though?

Send it all in writing to them, and if its a complaint they have, then tell them to follow ure complaints procedure.

If i had a situation like this, id hand it over to the other half :) She used to work for debt collection so knows how things work :)

Good idea if it's notifiable work to get the building compliance notice sent to your home address when registering the job, not the site address. That way you can withold it, and the certs until payment is made.

Agreed. On my estimates and invoices - I state that certs will only be issued upon FULL payment of job.

You might want to inform him that when they get involved his credit rating will get a bad mark, this alone may get him to pay up.

Sending your mates round is tempting, but it wont look good for your trade if word gets out.

There are supposed to be new laws coming into place to allow you to retrieve the items installed, at present once they are in place they become the property of the client, payed or not. But you probably know all that anyway.

You can get the council involved but its a pain and can take a while.

Small claims is a lot less painful then people think

Good luck

PS: I would chase it as other people may find out you let things go and then all his mates will be getting you round to do some free jobs too!!

thanks for the replys so far people. problem is these people are not stupid and quite well to do, on high payed jobs too. i have been emailing them back and forth all night and so far their answer is 'take me to court then'. i am 110% positive i would win the case as they have alreaddy agreed they owe me the money but just dragging it out as long as they can. what do u reckon boys and girls. its got me so wound up it really has. i was contemplating knocking the door and giving him a good hiding but i realise the potental consequences

Principles to one side, how important is that outstanding debt to you?

Is it your first?

Is

not the first, cant imagine it will be the last either. it just disgusts me to think people do this. if i walked into a shop and took something and refused to pay id be banged up for it. its a joke. what have others done in the mast for such small amounts? i know its only 100 quid but im fuming
What steps have you taken in writing?

Don

Sparkyt, what T&C's did you quote to the client concerned?Don & His Boys
